Privacy Policy

Effective as of December 16, 2016, Adeptec, Inc., and its subsidiaries, (collectively, “Adeptec” or “we” or “us” or “our”) have published our Privacy Policy (“Policy”); which applies to the use of our Websites and Services
(as herein defined).

1. Introduction.

The Policy is provided to describe Adeptec’s commitment to protecting the privacy of individuals who visit our Websites (“Visitors”), who register to use our Services (“Users”), or who register and attend sponsored events or other events at which Adeptec participates (“Attendees”).

For the purposes of this Policy, the term, “Websites”, shall refer collectively to www.adeptec.com as well as the other websites that Adeptec operates and that link to this Policy.

2. Modification.

If there are any changes to the Policy, we will notify you by posting the new policy on this page of our website. We encourage you to periodically review this page for the latest information for our privacy practices.

3. Acceptance.

The continued use of the Websites or the Services by you constitutes your agreement to be bound by this policy and acceptance of any changes to this Policy. Unless otherwise defined in this Policy, capitalized terms used below have the same meanings as in our Website Terms of Use.

Your only remedy, if you do not accept the terms of this Policy, is to discontinue use of and access to the Websites.

4. Information Collection and Use.

We collect information about you from various sources:

Children’s Personal Information:
We do not intentionally collect any personal information from children under the age of 13. If you are under the age of 13, please do not submit any personal information through our Websites or Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide personal information through the Websites or Services without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us through the Websites or Services, please contact our Legal department, and we will make a reasonable effort to delete that information.

Account and Registration Information:
We collect personal information about you such as your name, mailing address, phone number, and email address, as well as certain related information like your company name and website name, when you register for an account (“Account”) to access or utilize one or more of our Services.

We also ask for and collect personal information such as an email address and a name or alias from any individual that you authorize to log into and utilize our Services in connection with your Account.

For the purposes of this Policy, we refer to any information described above as “Account Information”. By voluntarily providing us with Account Information, you represent that you are the owner of such personal information or are otherwise authorized to provide it to us.

Log Data:
We collect log data information and store it in log files when you interact with our Websites and Services. This information includes, MAC address, internet protocol (IP) addresses, operating system, browser type, locale and language preferences, as well as date/time stamp, referral and exit pages, identification numbers associated with your devices, mobile unique device ID, and other similar information. We use the information gathered in our log files as needed for analytics and to improve our Websites and Services.

Cookies:
When you visit the Websites, we place a number of cookies in your browser. For example, we use cookies on the Websites to understand visitor and user preferences, improve their experience, and track and analyze usage, navigational and other statistical information.

5. Information Sharing and Disclosure.

We share your personal information with third parties only in the ways that are described in this Policy. Except as specifically noted below and in Section 5, we do not sell your personal information to, or share your personal information with, third parties for their promotional use or for their marketing purposes.

However, we do use certain information such as first name, last name, and email address for the purpose of our own marketing. By using the Services, you agree and consent to the use of this information by Adeptec and the sharing with its marketing partners and service providers, for Adeptec’s marketing purposes.

Analytics:
We collect analytics information when you use the Websites and Services. This information is used for the purpose of improving user experience. We may also share anonymous data about your actions on our Websites with third-party service providers of analytics services.

We also use mobile analytics software to allow us to better understand the functionality of our mobile application on your device. This software may record information such as how often you use the mobile application, the events that occur within the mobile application, aggregated usage, performance data, and where the mobile application was downloaded from.

We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.

Third Party Service Providers:
We will share your personal information with third parties who perform services on our behalf in order for us to provide you with our Services. Depending on the Services you have requested, we may share your name and e-mail address. We will also share your billing information with a credit card processing company in order to bill you for goods and services. These companies are authorized to use your personal information only as necessary to provide these services to Adeptec.

Business Transfers:
We may assign or transfer this Policy, as well as your account and related information and data, including any personal information, to any person or entity that acquires all or substantially all of our business, stock or assets, or with whom we merge.

In the event of a merger, acquisition, or any form of sale of some or all of our assets to a third party, we may also disclose your personal information to the third parties concerned or their professional advisors.

Compliance with Laws and Law Enforcement:
We may be required to disclose personal information in response to lawful requests made by government authorities. These requests may be for the purpose of investigating fraud or similar legal matters, complying with a subpoena, or in the interest of national security.

We will disclose your personal information only when we believe in good faith that the disclosure is necessary to protect our rights, protect your safety, or to protect the safety of others.

6. Supplemental Terms and Conditions for Certain Regions.

Canada:
Personal information (as the term is defined in the Personal Information Protection and Electronic Documents Act of Canada (“PIPEDA”)) will be collected, stored, used and/or processed by Adeptec in compliance with the Adeptec’s obligations under PIPEDA.

Australia:
Personal information collected, stored, used and/or processed by Adeptec, as described in this Policy, is collected, stored, used and/or processed in compliance with the Australian Privacy Act 1988 (Commonwealth) and the Australia Privacy Principles.

If you are dissatisfied with our handling of a complaint or do not agree with the resolution proposed by us, you may make a complaint to the Office of the Australian Information Commissioner (“OAIC”) by contacting the OAIC using the methods listed on their website at http://www.oaic.gov.au. Alternatively, you may request that we pass on the details of your complaint to the OAIC directly.

New Zealand:
Personal information collected, stored, used and/or processed by Adeptec, as described in this Policy, is collected, stored, used and/or processed in compliance with New Zealand’s Privacy Act 1993 and its 12 Information Privacy Principles (“NZ IPPs”).

Singapore:
Personal information collected, stored, used and/or processed by Adeptec, as described in this Policy, is collected, stored, used and/or processed in compliance with Adeptec’s obligations under the Personal Data Protection Act 2012 of Singapore (“PDPA”).

7. Correcting, Updating and Removing Your Information.

Upon request we will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. To request this information please contact our Legal department. Clients may update or change their Account Information by editing their profile or organization record or by contacting our Legal department for more detailed instructions. To make a request to have personal information maintained by us returned to you or removed, please email our Legal department. Requests to access, change, or remove your information will be handled within 14 days.

An individual who seeks access to, or who seeks to correct, amend, or delete inaccuracies in personal information stored or processed by us on behalf of a Subscriber should direct his/her query to the Subscriber (the data controller). Upon receipt of a request from one of our Clients for us to remove the data, we will respond to their request within thirty (14) days. We will retain personal information that we store and process on behalf of our Clients for as long as needed to provide the Services to our Clients. We will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. If you have any questions about the security of your personal information, you can contact our Legal department.

If you are a Client or otherwise provide us with personal information in connection with your use of our Websites or Services, we will delete this information upon your request, provided that, notwithstanding such request, this information may be retained for as long as you maintain an account for our Services, or as needed to provide you with our Services, comply with our legal obligations, resolve disputes and enforce our agreements.

8. General.

Security:
We have appropriate measures in place to protect your data when held by Adeptec that comply with relevant legal and best practice requirements. When you enter sensitive information (e.g. credit card or login credentials) as part of the enrollment process, we encrypt the transmission of that information using secure socket layer technology (SSL).

When you submit information to Adeptec through our website, you should be aware that your information is transmitted across the Internet and that no method of transmission over the Internet is completely secure. Although we take reasonable security measures to protect your information when we receive it, you also need to ensure you take appropriate steps to protect your information.

We will obtain assurances from any agents we may use to help provide this service that they will safeguard personal information consistently with this Policy, which assurance will require the agent to provide the same level of protection as is required by the relevant Safe Harbor Principles, the EU Data Protection Directive and the Privacy Shield Framework.

Links to Other Sites:
We may provide you with access to third party websites, databases, networks, servers, information, software, programs, systems, directories, applications, products or services, including without limitation, linked services (hereinafter “External Services”).

Adeptec does not have or maintain any control over External Services, and is not and cannot be held responsible for the content, operation or use. By linking or otherwise providing access to any External Services, Adeptec does not give any representation, warranty or endorsement, express or implied, with respect to the legality, accuracy, quality or authenticity of content, information or services provided by such External Services.

External Services may have their own terms of use and/or privacy policy, and may have different practices and requirements to the Websites operated by Adeptec. You are solely responsible for reviewing any terms of use, privacy policy or other terms governing your use of these External Services, which you use at your own risk. You are advised to make reasonable inquiries and investigations before entering into any transaction, financial or otherwise, and whether online or offline, with any third party related to any External Services.

English Version Controls:
Non-English translations of this Policy are provided for convenience only. In the event of any ambiguity or conflict between translations, the English version is authoritative and controls.

Non-Assignment:
You may not assign, sublicense, or transfer this Agreement or any rights or obligations hereunder without the prior written consent of Adeptec. Any such attempted assignment, sublicense, or transfer will be null and void and Adeptec, in its sole discretion, shall have the right to immediately terminate this Agreement.
